SHEPPARD AUDIO offers used and vintage equipment for sale.
Due to problems beyond our control arising from aging electronic components,
what may have checked out okay in our service facility, or by an onsite tech. inspection,
can not be guaranteed to continue to function in the way a new piece of equipment might be expected to.
As such, we offer no WARRANTY / GUARANTY on equipment purchased from us, unless provided in writing at the time of the sale.
ALL SALES ARE FINAL
WE ENCOURAGE A TECH. INSPECTION OF TAPE DECKS AND CONSOLES BEFORE PURCHASE.
WE HAVE TECH. CONTACTS EVERYWHERE AND CAN SET YOU UP WITH A LOCAL TECH. WHEN THE GEAR IS OUT OF OUR REACH.
Buyer Terms and
Conditions
Seller desires to provide its customers prompt and efficient service. However,
to negotiate individually the terms and conditions of each sales contract would
substantially impair Sellers ability to provide such service. Accordingly goods
furnished and services rendered by Seller are sold only on the terms and
conditions stated herein, not withstanding any terms or conditions on Buyers
order. Sellers performance of any contract is expressly made conditional on
Buyers agreement to Sellers Terms and Conditions of Sale, unless otherwise
specifically agreed to in writing by Seller. In the absence of such an
agreement, commencement of performance and / or delivery shall be for Buyers
convenience only and shall not be decreed or construed to be acceptance of
Buyers terms and conditions.
If a contract is not earlier formed by mutual agreement in writing, acceptance of any goods or services by Buyer shall be deemed acceptance of the terms and conditions stated herein.
USED or VINTAGE goods are sold in as is condition. No warranty or guarantee is implied unless stated in writing as to their serviceability or fitness for any purpose whatsoever. Buyer must satisfy himself or herself as to any purpose they wish to use the equipment for, as to its condition, its quality and its description.
All sales are final and shall not be invalidated due to any defect or fault in the merchandise or further due to any incorrect description by the seller or his agent.
Disputes
All disputes under any contract concerning the goods not otherwise resolved
between Seller and Buyer shall be resolved in a court of competent jurisdiction
for the location of Sellers place of business filing the order and in no other
place, provided, however, that in Sellers sole discretion such action may be
heard in some other place designated by Seller (if necessary to acquire
jurisdiction over third person), so that the dispute can be resolved in one
action. Buyer agrees to appear in any such action and hereby consents to the
jurisdiction of such court. No action, regardless of form arising out of, or in
any way connected with the goods furnished or services rendered by Seller, may
be brought by Buyer more than 30 days after the cause of the action has
occurred.
Governing Law
This agreement and performance by the parties herein shall be constituted in
accordance with the laws of the State of MA.
